No Investment Advice and Advisory-Boundary Acknowledgement
This acknowledgement records the boundary of the Platform with respect to Capital Markets Law No. 6362 and the CMB regulations on investment services and activities (including investment advisory, general investment recommendation and portfolio management). It is read together with the Terms of Use and the Fund Analysis Acknowledgement.
1. What is not offered
Fonigeo does not offer you or anyone investment advisory, personal investment advice, general investment recommendation, portfolio management, order transmission, brokerage or custody services. No investment advisory contract is formed with the user; no written advice report is produced; no suitability or appropriateness test is carried out; your financial situation, experience or risk profile is not officially determined. Fonigeo is not an investment firm and does not claim to hold an authorisation from the CMB for these activities.
2. General investment recommendation boundary
In capital-markets legislation, a general investment recommendation may be understood as guidance, not personalised, directed to the public or a group of customers on buying, selling or holding a particular capital-markets instrument. A fund code, name, ranking, filter, label, comparison, watchlist or analysis text on the Platform is not advice, instruction, encouragement, promotional steering or a commitment to buy, sell or hold a particular fund or to trade on a particular date. These elements display public data and mathematical summaries computed from historical data. Badges such as “ready” or “limited” describe data coverage; they are not trade suggestions.
3. Investment advisory boundary
Investment advisory is personalised guidance that takes the client’s financial situation and risk-return preferences into account. The Platform is not deemed to have researched on your behalf, got to know you or recommended an instrument to you. Support emails also carry no advisory character.
4. No agency relationship
Using the Platform creates no agency, representation, advisory, fiduciary relationship or portfolio-management authority. Fonigeo does not assume the consequences of your investment decision.
5. Tax, participation and third parties
Tax, withholding, TEFAS trading rules and participation/interest-free suitability assessment are for you and the competent authorities. Presenting outputs to others as advice, misleading them, or marketing them as advisory without your own licence is prohibited and breaches the Terms.
6. Risk acceptance
Capital-markets transactions are risky; part or all of the principal may be lost. Before deciding, only you and (if you wish) an authorised investment firm assess suitability to your situation, goals and risk appetite.
7. Acceptance
You accept that you understand the limits above; that you will not use any on-screen output as investment advice, general investment recommendation or advisory; and that the final decision and the tax, legal and financial consequences are yours.
